All affiliates must read and agree to the following terms and conditions.

This affiliate agreement contains the complete terms and conditions that apply to an individual’s or entity’s participation in the HostingBig Inc. Affiliate Program.

As used in this agreement, “we” refers to HostingBig Inc. and “you” refers to the applicant.

1. Enrollment in the program.

After you have submitted your application information to us, we will evaluate your application and notify you, by e-mail, of your acceptance. Your acceptance will be completed when you receive your affiliate’s acceptance email You will have access to the stats and banner area all traffic will be counted pending your acceptance . So if you follow our simple rules you will be paid

We may reject your application or terminate your account and this agreement, without any advance notice, if we determine (at our sole discretion), at any time, that your site, or our relationship with you, is unsuitable for us.

Web Sites, which are considered unsuitable for our Affiliate Program include, but are not limited to, those that:
* promote violence;
* promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
* promote illegal activities or violate intellectual property rights;
* are non English;
* have gaming, warez or adult content.
* Or any other site we determine is unacceptable

* You must send traffic from a fully qualified domain or the software will not count it ;
* Sending the link via email will not work so do not waste your time it wont be counted;
* Trying to use the above is considered SPAM you will be reported to your ISP and or authorities
* Using scripts and redirects to artificially inflate your traffic is unacceptable
* Forcing your website visitors to click your sponsor links before they can continue is unacceptable
* any webmaster caught cheating will have their account terminated all moneys owed will be forfeited

In this regard, you understand that we reserve the right to conclude that your Web Site is unacceptable in accordance with our standards; such as they are, from time to time, without any duty to prove the basis of our rejection of your application, or provide any prior notice of such rejection.

2. Payout and conditions.

2.1. Click-through rate.

As an additional incentive during the term of this agreement, you will receive $25.00, $35.00, $50.00 for each Sale, depending on which service you sell. (See below for payment schedule)

Shared Hosting $25:00 (30 day hold to honor our guarantee)

Virtual Private Servers $35.00 (30 day hold to honor our guarantee)

Dedicated Servers (60 day Hold for set up & to Honor our guarantee)

If we suspect you are fraudulent as to this practice, we reserve the right to immediately terminate your account and this agreement, without any notice.

3. Choosing your banner or link and placing it on your site.

Once approved, you will have access to our affiliate area with a selection of links and banners that will allow visitors to click-through to our site. In order for your account to become active, you must place one of these on your site.

Each of these will contain a tracking cookie and a referral system. We assume all responsibility for tracking of click-throughs and applications on our site and our records will constitute proof of the number of click-throughs, for any affiliates.

You must place at least one of these on your site within a time period of five (5) days from receiving your acceptance email confirmation, or your account and this agreement will be terminated.

Nothing in this agreement shall grant to you any rights in any of our intellectual property other than a limited right to use the links and banners provided to you for only the specific purposes described herein; any other use of any of our intellectual property, or any likeness thereto, is expressly forbidden and shall entitle us to terminate your account and this agreement and be a basis on which you shall return to us all funds provided to you thereunder and all other applicable damages. Other than using the buttons, links and banners provided to you by us on your Web Site, you shall not make any reference to us, or any of our affiliates, on your Web Site, or any Web Site over which you or your affiliates have control, without prior written consent from us.

You agree to not disclose to any other person or entity any information concerning potential customers of ours.

4. Modifications

We may modify any of the terms and conditions contained in this agreement, at any time and in our sole discretion. You will be contacted on the effective date of change. It is therefore important that you supply us with current contact information, including e-mail and mailing address.

If any modification is unacceptable to you, your only recourse is to terminate this agreement. Under no circumstances will we be liable to you hereunder for any amounts in excess of the click-through rate incentive, if any. We shall, under no circumstances be liable to you or any merchant for any incidental, consequential or other damages, losses or claims in any way connected with or arising out of our performance thereunder or under any agreement with any merchant.

You represent to us that you are a person or legal entity operating an enterprise and not an individual consumer.

This agreement shall be governed by the laws of the State of California and the federal laws of United States applicable therein.

I have read and understood this agreement. I agree with the above conditions and responsibilities of the HostingBig affiliate program.

I understand that HostingBig also reserves the right to cancel an affiliate’s membership if HostingBig believes the above mentioned has not respected the terms of this agreement.
